Auto Injury Cases

If You Were At-Fault

If you were responsible for the accident, you may have the following options to cover your treatment:

• Personal Injury Protection (PIP) or Medical Payments (MedPay) – These cover medical expenses regardless of fault, depending on your auto insurance policy.

• Health Insurance – You can use your health insurance plan, but be sure to check for deductibles, co-pays, and any exclusions related to auto accident injuries.

If Someone Else Was At-Fault

If another driver is responsible for the accident and has accepted liability, you may be able to:

• File a Claim with Their Auto Insurance – Their liability coverage may cover your medical expenses. However, be cautious, as insurance companies may attempt to settle quickly for a lump sum, which often limits future claims. Once a settlement is accepted, further claims are usually not allowed, even if additional medical issues arise later.

• Attorney Representation – Not all medical providers or imaging centers accept direct payments from auto insurers due to their frequent payment limitations. An attorney can help ensure you receive necessary medical care promptly and negotiate fair coverage for your treatment. Legal representation is especially helpful if:

  • There is no police report.

  • The other party has not accepted liability.

  • Multiple vehicles were involved in the accident.
